These Terms & Conditions govern the use of services provided by Spatialwerks and the use of this website. By accessing this website or engaging Spatialwerks for drafting or technical support services, you agree to the terms outlined below.
1. Services Provided
Spatialwerks provides professional drafting and CAD support services for architecture, engineering, surveying, construction, and related project teams. Services may include production drafting, redline revisions, as-built documentation, CAD cleanup, file organization, PDF-to-CAD conversion, and related technical drafting support.
Spatialwerks provides drafting and technical support services only and does not offer licensed architectural, engineering, or surveying services.
2. Scope of Work
All services are performed based on a defined scope of work established through written proposals, agreements, email correspondence, or documented client instructions. Any work requested outside the agreed scope may require additional authorization, time, and fees.
Spatialwerks reserves the right to pause or decline work that falls outside the agreed scope until appropriate revisions to the scope are confirmed.
3. Client Responsibilities
Clients are responsible for providing accurate, complete, and timely information, including drawings, specifications, markups, reference files, and approvals. Spatialwerks is not responsible for errors, omissions, or delays resulting from incomplete, inaccurate, or outdated information supplied by the client.
Clients are also responsible for reviewing and approving all deliverables prior to use, submission, or construction.
4. Revisions and Changes
Reasonable revisions consistent with the original scope of work are included unless otherwise specified. Substantial revisions, additional design changes, or scope modifications may require additional time and fees, which will be communicated prior to proceeding.
5. Fees and Payment
Fees, billing structure, and payment terms will be outlined in the applicable proposal, agreement, or invoice. Payment is due according to the agreed terms. Late or unpaid invoices may result in suspension of services until payment is received.
Spatialwerks reserves the right to withhold deliverables for unpaid balances where permitted by law.
6. Intellectual Property
Upon full payment, the client retains ownership of final deliverables produced specifically for their project. Spatialwerks retains ownership of all working files, templates, processes, and non-project-specific materials unless otherwise agreed in writing.
Spatialwerks may retain copies of project files for record-keeping purposes and may use non-confidential, anonymized work samples for portfolio or marketing purposes unless otherwise restricted by written agreement.
7. Website Information Accuracy
The information provided on this website is intended for general informational purposes only. While Spatialwerks makes reasonable efforts to ensure that website content is accurate, current, and relevant, we do not guarantee the completeness, accuracy, or reliability of any information presented.

8. Limitation of Liability
To the maximum extent permitted by law, Spatialwerks’ liability for any claim arising out of or related to services provided shall be limited to the total fees paid by the client for the services giving rise to the claim.
Spatialwerks shall not be liable for indirect, incidental, consequential, or special damages, including loss of profits, loss of data, or project delays, even if advised of the possibility of such damages.
9. No Licensed Design Services
Spatialwerks does not provide licensed architectural, engineering, or surveying services. All drawings and documentation produced by Spatialwerks must be reviewed, approved, and stamped by the appropriate licensed professional where required before use for permitting, construction, or record purposes.
10. Confidentiality
Spatialwerks will treat all client-provided information, drawings, and project materials as confidential and will not disclose such information to third parties except as necessary to perform services or as required by law.
11. Termination
Either party may terminate services with written notice. The client is responsible for payment of all work performed up to the effective date of termination.
12. Governing Law
These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the State of Florida, without regard to conflict of law principles.
13. Modifications
Spatialwerks reserves the right to modify or update these Terms & Conditions at any time. Updates will be effective upon posting to this website.
